These Terms and Conditions govern your use of our website and your purchase or use of our products and services, including courses, digital products, ebooks, templates, downloads, AI assistants, custom GPTs, coaching, communities, email communications, and other content or services provided by Arkfeld Academy.

By accessing our website, purchasing a product or service, creating an account, or using our products or services, you agree to these Terms and Conditions.

If you don’t agree with these Terms, please don’t use our website or purchase or use our products or services.

Eligibility

You must be at least 18 years old to use our website or purchase our products or services.

By using our website or making a purchase, you represent that you are at least 18 years of age and legally able to enter into an agreement.

Intellectual Property

Unless otherwise stated, all content provided by Arkfeld Academy is owned by or licensed to Arkfeld Academy and is protected by applicable copyright, trademark, and other intellectual property laws.

This includes courses, ebooks, worksheets, templates, downloads, videos, graphics, logos, written content, prompts, AI assistants, custom GPTs, training materials, email content, recordings, presentations, workbooks, and other materials.

Your purchase grants you a limited, revocable, non-exclusive, non-transferable license to use the purchased materials for your own personal use.

Unless we provide written permission, you may not

• Copy, reproduce, republish, or distribute our content
• Share purchased materials or downloads with others
• Share account or login credentials
• Resell, sublicense, or redistribute our products
• Modify our materials for resale or redistribution
• Upload our materials to another website, platform, course, membership, AI tool, or database for distribution to others
• Claim our content or materials as your own
• Use our materials to create substantially similar products for resale or distribution
• Remove copyright, trademark, or other ownership notices from our materials

Nothing in these Terms transfers ownership of Arkfeld Academy intellectual property to you.

Digital Products and Course Access

When you purchase a course, ebook, template, AI assistant, custom GPT, downloadable resource, or other digital product, you receive access according to the terms provided on the applicable sales page, checkout page, or product description.

Some products may provide immediate access, while others may become available on a future date or according to a release schedule.

All purchases are intended for a single user unless we specifically state otherwise.

Sharing login credentials, course access, AI assistant access, custom GPT access, downloads, community access, or other purchased materials with another person is prohibited.

If we reasonably determine that materials or account access have been shared, copied, distributed, resold, or otherwise used in violation of these Terms, we may suspend or revoke access without refund.

Lifetime Access

Some Arkfeld Academy products, courses, communities, groups, resources, or services may be described as including “lifetime access.”

Unless specifically stated otherwise, “lifetime access” means access for the lifetime of the applicable product, program, community, or service, not the lifetime of the purchaser.

We may discontinue a product, program, community, platform, group, or service in the future. If that occurs, access may end when the applicable product, program, community, or service is discontinued.

Lifetime access doesn’t guarantee that a product, course, community, Facebook group, AI tool, third-party platform, or other resource will remain available indefinitely or in its original format.

We may change the platform, delivery method, content, features, or location of a product or community when reasonably necessary. For example, a community originally hosted in a Facebook group may later be moved to another platform.

When reasonably practical, we will provide notice of significant changes or discontinuation and may provide an opportunity to download eligible materials before access ends.

Product Changes and Availability

We may update, modify, replace, or discontinue products, services, lessons, bonuses, resources, platforms, or features when reasonably necessary.

We may also update materials to reflect changes in technology, platforms, business practices, laws, or other circumstances.

When practical, we may replace a discontinued resource or feature with a substantially similar resource or alternative.

Purchasing a product doesn’t guarantee that every feature, resource, technology, third-party platform, or delivery method available at the time of purchase will remain available indefinitely.

Payment and Pricing

All prices are listed in U.S. dollars unless otherwise stated.

By purchasing a product or service, you agree to provide accurate billing information and authorize the payment method used at checkout to be charged according to the terms of your purchase.

We may change our prices at any time. Price changes won’t affect completed purchases unless otherwise stated as part of an ongoing or recurring service.

Discounts, promotional offers, and coupon codes may have separate eligibility requirements and expiration dates and may not be combined unless specifically stated.

Payment Plans

Some products or services may be offered using an installment payment plan.

By selecting a payment plan, you’re agreeing to pay the full purchase price in the stated number of installments. A payment plan isn’t a month-to-month subscription and doesn’t allow you to cancel your remaining payments simply because you stop participating in or using the product.

You authorize us and our payment processor to charge the payment method provided at checkout for each scheduled installment.

If a scheduled payment fails, we may temporarily suspend access to the applicable products, courses, bonuses, coaching, communities, or other services until the account is brought current.

If you qualify for and receive a refund under an applicable refund policy or guarantee, any remaining installment obligations associated with that refunded purchase will be canceled unless otherwise stated.

Refund Policy

Because our products and services include digital content, educational materials, downloads, tools, and other resources, all sales are final unless a specific refund policy or guarantee is stated on the applicable sales page, checkout page, product description, or within these Terms.

No refunds will be provided for courses, digital products, ebooks, templates, worksheets, downloads, AI assistants, custom GPTs, prompt libraries, toolkits, coaching, or other digital resources unless a specific refund policy or guarantee applies to the purchase.

If a product or service has its own refund policy, that product-specific policy will control.

Digital Business Blueprint 14-Day Action-Taker Guarantee

The Digital Business Blueprint is covered by a limited 14-Day Action-Taker Guarantee.

To qualify for a refund, you must

• Submit your refund request within 14 calendar days of receiving access to the course
• Complete all lessons, worksheets, assignments, and required action items contained in Week 0, Week 1, and Week 2 of the program
• Provide reasonable proof that you’ve completed the required work

The purpose of this guarantee is to give students an opportunity to evaluate the program after actively participating in the required lessons and assignments.

Refunds won’t be issued to students who haven’t completed the required lessons and assignments or who request a refund without demonstrating a good-faith effort to participate in the program.

If you meet these requirements and determine that The Digital Business Blueprint isn’t a good fit for you, email sherry@arkfeldacademy.com within 14 calendar days of receiving course access to request a refund.

Arkfeld Academy reserves the right to deny refund requests that don’t meet the stated requirements of this guarantee.

Chargebacks and Payment Disputes

If you have a concern about a purchase, please contact us at sherry@arkfeldacademy.com so we have an opportunity to address the issue.

If you initiate a chargeback, payment dispute, or payment reversal, we may suspend access to the products, courses, bonuses, communities, coaching, downloads, or services associated with the disputed purchase while the dispute is being reviewed.

Nothing in this section limits any rights you may have under applicable law or through your payment provider.

Bonuses and Promotional Materials

Some purchases may include bonuses, promotional materials, additional training, AI tools, templates, downloads, coaching, or other resources.

Unless otherwise stated, bonuses have no separate cash value and aren’t separately refundable or redeemable for cash.

We may modify or replace a bonus if the original resource becomes unavailable or impractical to provide. When reasonably possible, we may substitute a substantially similar resource.

Time-sensitive bonuses, coaching sessions, or other benefits must be used within any deadlines stated on the applicable sales page, checkout page, confirmation email, welcome materials, or scheduling page.

Unused bonuses or services don’t create a right to a refund unless otherwise required by law.

Coaching and Educational Services

Any coaching, group coaching, workshops, live events, consultations, feedback, or similar services provided by Arkfeld Academy are educational in nature.

Coaching doesn’t constitute legal, financial, tax, accounting, medical, mental health, or other licensed professional advice.

You’re responsible for your own business decisions and for determining whether advice, ideas, strategies, or recommendations are appropriate for your circumstances.

We don’t guarantee any particular result from coaching or educational services.

Coaching sessions may be subject to scheduling requirements, expiration dates, attendance policies, or other conditions disclosed when you purchase or schedule the service.

Unless otherwise stated, unused coaching sessions have no cash value and aren’t refundable after the applicable scheduling or availability period expires.

Educational and Informational Purposes

All information provided through our website, courses, coaching, ebooks, AI assistants, custom GPTs, emails, downloads, communities, and other materials is intended for educational and informational purposes only.

Nothing provided by Arkfeld Academy constitutes financial, legal, tax, accounting, medical, or other licensed professional advice.

You are responsible for evaluating information and making your own decisions based on your circumstances.

When professional advice is appropriate, you should consult a qualified professional.

Earnings and Business Results Disclaimer

Arkfeld Academy provides education related to topics that may include online business, side hustles, digital products, artificial intelligence, marketing, content creation, and income generation.

We don’t guarantee income, earnings, sales, customers, profits, business growth, financial success, return on investment, or any other specific business or financial result.

Business results depend on many factors outside our control, including your effort, experience, skills, decisions, implementation, market conditions, audience, product, pricing, competition, and individual circumstances.

Examples, demonstrations, case studies, testimonials, student experiences, and personal experiences may be used to illustrate concepts or show what an individual has experienced. They aren’t promises or guarantees that you will achieve the same or similar results.

You acknowledge that starting and operating a business involves risk and that it’s possible to spend money without earning it back.

You’re solely responsible for decisions you make and actions you take based on our educational materials.

AI Content and Tools

Some Arkfeld Academy products and services use or teach artificial intelligence technologies, including AI assistants, custom GPTs, generative AI tools, and AI-generated content.

Artificial intelligence can produce inaccurate, incomplete, outdated, biased, or otherwise incorrect information.

You’re responsible for reviewing, editing, fact-checking, and verifying AI-generated content before using, publishing, distributing, submitting, or relying on it.

You’re also responsible for ensuring your use of AI-generated content complies with applicable laws, intellectual property requirements, platform policies, professional obligations, and industry regulations.

AI platforms, models, features, integrations, pricing, policies, and functionality may change or become unavailable without notice.

Your purchase of an Arkfeld Academy product doesn’t guarantee permanent access to any particular third-party AI model, platform, feature, integration, assistant, or technology.

Arkfeld Academy isn’t responsible for decisions made or actions taken based solely on AI-generated information.

Technology and Third-Party Service Availability

Our products and services may rely on third-party platforms and technology providers, including OpenAI, Canva, Kit, Systeme.io, ThriveCart, WordPress, Meta, Google, and other providers.

We don’t control these third-party services and can’t guarantee their continued availability, functionality, pricing, policies, or features.

We aren’t responsible for interruptions, outages, feature changes, account restrictions, pricing changes, policy changes, discontinued services, data loss, or other problems caused by third-party providers.

Features, functionality, screenshots, demonstrations, and instructions contained in our educational materials may become outdated as third-party platforms change.

We may update our materials when appropriate, but we don’t guarantee that every lesson, screenshot, demonstration, or instruction will always reflect the latest version of every third-party platform.

Third-Party Links and Resources

We may moderate content and remove participants from communities, coaching programs, live events, or other interactive services when we reasonably believe these rules have been violated.

Serious or repeated violations may result in removal without refund, to the extent permitted by applicable law.

This provision doesn’t apply to the extent a claim results from conduct for which liability can’t legally be excluded or shifted under applicable law.

These communications may include purchase confirmations, receipts, account information, course-access information, product updates, scheduling information, policy notices, and other communications related to products or services you’ve requested.

Marketing emails are subject to applicable law and our email practices. You may unsubscribe from marketing emails using the unsubscribe option provided in those communications.

Unsubscribing from marketing emails doesn’t prevent us from sending transactional or service-related communications when necessary.

Assignment and Transfer

Your rights to access purchased products, services, accounts, coaching, communities, or materials are personal to you and may not be assigned or transferred to another person without our written permission.

Nothing in these Terms limits any consumer protection rights that can’t legally be waived under applicable law.

No Waiver

If we don’t enforce a provision of these Terms on one occasion, that doesn’t waive our right to enforce that provision or any other provision in the future.

These Terms and Conditions, together with any applicable product-specific terms, checkout terms, refund policies, and policies expressly incorporated by reference, constitute the agreement between you and Arkfeld Academy regarding your use or purchase of the applicable products and services.

If a product-specific term conflicts with these general Terms, the product-specific term will control for that product.

Changes will apply prospectively unless otherwise permitted or required by law.
